A panel of EULEX judges acquitted two persons charged with the criminal offence of rape as a war crime and convicted only one of them for unauthorised ownership, control, possession or use of weapons.
J. D. was found not guilty for rape as a war crime and unauthorised ownership, control, possession or use of weapons. D.B. was found not guilty rape as a war crime, but was convicted for unauthorised ownership, control, possession or use of weapons and sentenced to one year and six months of imprisonment. His sentence was suspended for a verification period of two years. The court acquitted the J.D. and D.B. for war crimes because it was not proven beyond reasonable doubt that the defendants committed the offences they were charged with.
The case was prosecuted by EULEX special prosecutors from the Special Prosecution Office of Kosovo.
