A mixed panel of two EULEX judges and one Kosovo judge, presided over by a EULEX judge at the District Court of Peja/Peċ found D.K. guilty of Aggravated Murder and Unauthorized Ownership, Control, Possession or Use of Weapons and sentenced him to 23 years of imprisonment.
In the same trial, the panel found F.G. guilty of Causing General Danger and Unauthorized Ownership, Control, Possession or Use of Weapons and sentenced him to two years of imprisonment.
The panel found D.K. guilty because he fired at close range from his weapon with the intention of killing the defendant F.G. in September 2011 in Peja/Peċ. One of the bullets fired by D.K. hit and killed the deceased K.I..
F.G. acting in self-defence but in a manner that was disproportionate to the degree of danger posed by the attack upon him, fired his weapon in the direction of D.K.. His actions exposed passers-by to an obvious danger to human life. One of the bullets injured a bystander.
The case was prosecuted by EULEX district prosecutors.
