A mixed panel of two EULEX judges and one local judge at the District Court of Mitrovicë/Mitrovica, on 16 February 2012, found X.P. from Bosnia and Herzegovina guilty of Unauthorized Supply, Transport, Production, Exchange or Sale of Weapons, contrary to Article 327, of the Criminal Code of Kosovo (CCK), and sentenced him to 1 year and 10 months of imprisonment.
Considering the time already spent in detention on remand, the panel issued a separate ruling cancelling the detention on remand of the accused Prelevic and ordered his immediate release.
In April 2010, seventeen (17) pistols, and nine thousand six hundred and forty bullets (9640) transported from Sarajevo to Kosovo were seized from the car of the accused, when he was stopped by the customs patrol unit at the Mitrovicë/Mitrovica municipality.
On 15 February 2012, the EULEX prosecutor withdrew the charges against two other defendants of the case, H.A. and I.A. and as a consequence the court rejected the charges against them.
H.A. was charged with the criminal offences of Unauthorized Supply, Transport, Production, Exchange or Sale of Weapons, contrary to Article 327, of the CCK and Unauthorized Ownership, Control, Possession or Use of Weapons, contrary to Article 328, of the CCK.
I.A. was charged with Unauthorized Ownership, Control, Possession and Use of Weapons, contrary to Article 328, of the CCK, and the charges have been rejected.
The case was prosecuted by a EULEX prosecutor, who indicated an appeal against the sentence imposed upon Prelevic.
