Supreme Court modifies murder sentence

A mixed panel of two EULEX judges and three Kosovo judges, presided over by a EULEX judge at the Supreme Court modified the aggregate punishment against O.Z. from 25 years to 15 years of imprisonment.

The Supreme Court panel, acting as a second instance court, found O.Z. guilty for the criminal offences of murder, attempted murder and unauthorized ownership, control, possession or use of weapons. The original punishment was reduced due to a different assessment of the legal qualification and the fact that the defendant committed the murder with diminished capacity.

O.Z. was accused of shooting and killing H.R. and wounding his brother N.R. in October 2005 in the market of Xerxe/Zerze village, Prizren municipality.

The case was prosecuted by a EULEX district prosecutor.
